Hutt City Council is carrying out consultation to seek the community’s view on a proposal to classify four properties within Walter Mildenhall Park as Local Purpose Reserve (Community Buildings). This consultation is being carried out in accordance with Section 16 of the Reserves Act.
The task of classification is an administrative one, which would result in the four certificate of titles being updated so that the Reserves Act status of each property is clearly understood. Classification requires approval from Council after consultation has been carried out.
The deadline for submissions is Friday 22 June, 2018.
Reserves are classified to ensure their control, management, development, use and preservation for appropriate purposes, for example recreation or scenic values.
The proposal to declare and classify properties as reserve has been initiated by Council officers in anticipation of a new Community Hub being developed at Walter Mildenhall Park during 2018 and 2019.
As part of the preliminary site investigations and planning for the new Community Hub, officers checked the certificates of title for Council-owned reserve properties within Walter Mildenhall Park. Although the four properties comprising Walter Mildenhall Park all had Reserves Act status, none of the four properties were classified.
The proposal is to classify all four properties in Walter Mildenhall Park as Local Purpose Reserve (Community Buildings).

The four properties already have status under the Reserves Act 1977. In reality, there is unlikely to be any material effect on the properties. Declaration and classification is an administrative process. The Reserves Act Classification is recorded on the Certificates of Title. Classifying land as reserve makes the principal purpose of the reserve clear. This affects Council’s management and decision-making.
Classification as Local Purpose Reserves (Community Buildings) will mean that the land will continue to be managed with an emphasis on:
If classification occurs, it will be possible to issue a lease under the Reserves Act to the Community Facilities Trust for the area of the proposed Community Hub. Development of the new hub and the activities that occur within the Community Hub need to be consistent with the classification and the HCC Facilities Reserve Management Plan. Note that this does not reduce requirements to comply with the RMA and the HCC District Plan or other plans, policies, by-laws and legislation.
The Reserves Act 1977 requires consultation with the public before important decisions about reserves are made by Council. The Act requires Council to prepare Reserve Management Plans to provide the community with certainty about the function and management of reserves. Reserves Act processes are prescribed in the Act. The Reserves Act is administered by the Department of Conservation.
The declaration and classification is just a proposal at the moment. No decision has been made on the proposal to declare or classify the properties as reserve at this time.
